I am in contact with someone that is willing to help me with my build. The question is. Can I send him my front half and have him weld it together, then send it back to me. Then send him my rear half pieces from IMA and have him weld it together, then send it back to me so I can weld the front and rear halves together myself. Would there be anything illegal about that? Given that the semi mods to the receiver are done before returning to me.

Sure it's building a receiver, a semi-auto receiver, which is legal to build.

Sounds legal to me, since you'd be the one welding the front and rear halves together. Welding together the sub groups such as the front and rear sections isn't building anything, so having your friend do that is OK.

Since you're welding together the front and back half, you're the one who is building the semi receiver.

J,

You have two people assembling a receiver. Remember it has to be cut into 4 section to be considered a non firearm. I think I can here the word conspiracy. Anyways for a home build the owner needs to do the work is my understanding. I would not want to be sending that through the USPS.

Anyone want to call the BAFTE and get an opinion that counts?

Now if his buddy has an FFL that would be another story.

By today's standards, the receiver must be destroyed with 4 cuts. That has been done. If two or more of those 5 pieces of steel are welded back together, it does not suddenly become a firearm again until they are ALL welded back together.

It is not a receiver until the pieces become one piece. Welding together a front or back half is not building a receiver, it's just welding scrap metal pieces together. Welding pieces of scrap metal together to make a bigger piece of scrap metal does not require a manufacturer's FFL.

It is not a firearm until assembly is completed, which is done by the private owner.

There is nothing illegal about sending scrap metal through the mail.

What if he bought a back half kit from BRP and had someone weld the two rear pieces together? Would that require a license too? Of course not. What if he found a front half that was already together? Is that already a firearm? Of course not.

I'm not a lawyer so don't take anything I say as fact. I would also say not to take legal advice from the Internet.

With the atmosphere in government and the country today, I think someone could make it very difficult for you. Now, if you have deep pockets go for it.

My advice is just take a road trip and get it done in one go.

This question has come up several times as of late... Will you please re-weld my receiver.. Sometimes I guess about who is posting the request.
My thoughts are think a lot about having someone else do this work for you. You can legally do the weld..
Having someone else do it is of question. Both of the above parties have different views on this and I respect both of the parties. Now mix is someone from the legal beagle anti gun group and see what type of a brew that you get.
Legal ?? Might be then again might not be.
Cost proving it legal after a problem comes up could be in the thousands. Think first.
